These Terms of Service govern your use of the Sparkline Software website and any related services. Sparkline Software is a trading name under which software development services are provided. By accessing this site or engaging services, you agree to these Terms.
Sparkline Software provides custom software development and related services to businesses or individuals. Any services offered are subject to a separate written agreement, proposal, or invoice. This website is provided for informational purposes only and does not constitute a binding contract.
Unless otherwise agreed in writing, upon full payment for custom development services, ownership of the final deliverables created specifically for a client will transfer to that client. Sparkline Software retains the right to reuse general knowledge, techniques, libraries, non-client-specific code, and tooling developed during the course of work. Sparkline Software also reserves the right to reference completed projects in portfolios or case studies, unless otherwise agreed.
Payment terms are defined in individual proposals, invoices, or service agreements. A deposit may be required before work begins. Late or non-payment may result in suspension of work or withholding of deliverables until payment is received.
To the maximum extent permitted by law, Sparkline Software shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of this site or provided services. Total liability for any claim shall not exceed the total fees paid for the services giving rise to the claim. Nothing in these Terms limits liability where such limitation is prohibited by law.
Access to the website may be suspended or terminated where misuse, abuse, or unlawful activity is identified. Termination of services is governed by the terms of the applicable service agreement.
These Terms are governed by the laws of Ireland. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Ireland.
